Fr\u012bdenberga teic, ka liel\u0101k\u0101 da\u013ca no 77 Latvijas soci\u0101lajiem uz\u0146\u0113mumiem ir nelieli vai jauni. Vien neliela da\u013ca no \u0161iem uz\u0146\u0113mumiem sp\u0113j patst\u0101v\u012bgi piedal\u012bties publiskaj\u0101 iepirkum\u0101. A. Fr\u012bdenberga uzsver \u2013 soci\u0101lie uz\u0146\u0113mumi ir labi un uzticami sadarb\u012bbas partneri uz\u0146\u0113mumiem, kas v\u0113las b\u016bt soci\u0101li atbild\u012bgi. Soci\u0101lajiem uz\u0146\u0113mumiem ir divas iesp\u0113jas \u2013 patst\u0101v\u012bgi piedal\u012bties publisk\u0101 iepirkuma proces\u0101 vai piedal\u012bties, l\u012bdzdarbojoties vai sadarbojoties ar parasto uz\u0146\u0113mumu. A. Fr\u012bdenberga secina \u2013 patlaban Latvij\u0101 publisko iepirkumu sist\u0113mu soci\u0101lo samezglojumu risin\u0101\u0161anai neizmanto. Tom\u0113r, veidojot soci\u0101li atbild\u012bgu iepirkumu, tas var b\u016bt efekt\u012bvs l\u012bdzeklis soci\u0101lo probl\u0113mu risin\u0101\u0161anai.<\/p>\n<p>BSI p\u0113tniece nosauc \u0161\u0101dus izaicin\u0101jumus soci\u0101lo uz\u0146\u0113mumu iesaistei publiskajos iepirkumos: 1) saprast, ka publiskie iepirkumi ir v\u0113l viens r\u012bks soci\u0101lo samezglojumu risin\u0101\u0161anai, 2) atrast pieg\u0101d\u0101t\u0101ja\/pas\u016bt\u012bt\u0101ja sadarb\u012bbas veidu ar soci\u0101lo uz\u0146\u0113mumu vai nevalstisko organiz\u0101ciju (NVO), 3) rad\u012bt piepras\u012bjumu, tad rad\u012bsies ar\u012b pied\u0101v\u0101jums, 4) uzdr\u012bkst\u0113ties, 5) l\u012bdzdarboties un b\u016bt l\u012bdzatbild\u012bgam publisko iepirkumu izpild\u0113.<\/p>\n<p>Lai rosin\u0101tu atbild\u012bgu iepirkumu, ir j\u0101saprot, ka publiskais iepirkums ir visu m\u016bsu (sabiedr\u012bbas) nauda un visl\u0113t\u0101kais ne vienm\u0113r ir vislab\u0101kais. \u201cJ\u0101main\u0101s un j\u0101dara cit\u0101di!\u201d aicina A. Fr\u012bdenberga.<\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Soci\u0101lie krit\u0113riji publiskajos iepirkumos<\/span><\/b><\/p>\n<p>Krist\u012bne Gaigule-\u0160\u0101v\u0113ja, zv\u0113rin\u0101tu advok\u0101tu biroja \u201cPRIMUS DERLING\u201d partnere, zv\u0113rin\u0101ta advok\u0101te, sav\u0101 prezent\u0101cij\u0101 (p\u0113t\u012bjum\u0101) \u201cSoci\u0101lie krit\u0113riji publiskajos iepirkumos Latvij\u0101\u201d v\u0113rsa uzman\u012bbu, ka PIL regul\u0113jums ietver pien\u0101kumus un ties\u012bbas (iesp\u0113jas) pas\u016bt\u012bt\u0101jam izmantot \u201csoci\u0101los krit\u0113rijus\u201d publiskaj\u0101 iepirkum\u0101. Soci\u0101los krit\u0113rijus nosac\u012bti var iedal\u012bt div\u0101s da\u013c\u0101s: <b>privile\u0123\u0113tie l\u012bgumi<\/b> un <b>soci\u0101l\u0101s klauzulas. Soci\u0101l\u0101s klauzulas<\/b> ir sastopamas vair\u0101k\u0101s PIL norm\u0101s, proti:<\/p>\n<ul>\n<li>\tizsl\u0113g\u0161anas noteikumi;<\/li>\n<li>\ttehnisk\u0101s specifik\u0101cijas;<\/li>\n<li>\tmar\u0137\u0113jumi;<\/li>\n<li>\tiepirkuma sadal\u012b\u0161ana da\u013c\u0101s;<\/li>\n<li>\tpieredzes pras\u012bbas;<\/li>\n<li>\tv\u0113rt\u0113\u0161anas krit\u0113riji;<\/li>\n<li>\tl\u012bguma izpildes noteikumi;<\/li>\n<li>\tpras\u012bbas nepamatoti l\u0113ta pied\u0101v\u0101juma noraid\u012b\u0161anai;<\/li>\n<li>\tapsprie\u0161an\u0101s ar pieg\u0101d\u0101t\u0101jiem.<\/li>\n<\/ul>\n<p>Par <b>privile\u0123\u0113tajiem l\u012bgumiem<\/b> run\u0101 PIL 16. pants. Taj\u0101 teikts, ka sl\u0113gt privile\u0123\u0113to l\u012bgumu ir pas\u016bt\u012bt\u0101ja ties\u012bbas (izv\u0113le), kuru var izmantot PIL 16. pant\u0101 min\u0113tajos gad\u012bjumos, rezerv\u0113jot ties\u012bbas piedal\u012bties tikai noteiktiem soci\u0101liem krit\u0113rijiem atbilsto\u0161iem uz\u0146\u0113mumiem.<\/p>\n<p>Latvij\u0101 past\u0101v divi veidi, k\u0101dos ir iesp\u0113jams sl\u0113gt privile\u0123\u0113to iepirkuma l\u012bgumu. PIL 16. panta 1. da\u013c\u0101 ir teikts, ka \u201cpas\u016bt\u012bt\u0101jam noteikt\u0101m personu grup\u0101m paredz\u0113tu pas\u0101kumu ietvaros ir iesp\u0113ja rezerv\u0113t ties\u012bbas piedal\u012bties publiskaj\u0101 iepirkum\u0101 t\u0101dai personai, kurai vair\u0101k nek\u0101 30% no vid\u0113j\u0101 nodarbin\u0101to darbinieku skaita gad\u0101 ir <b>personas ar invalidit\u0101ti<\/b>\u201d. (Ar noteikumu, ka iepirkuma priek\u0161mets to pie\u013cauj \u2013 l\u012bgumu var\u0113s izpild\u012bt.)<\/p>\n<p>K. Gaigule-\u0160\u0101v\u0113ja v\u0113r\u0161 uzman\u012bbu uz to, ka Latvija \u0161o <i>Direkt\u012bvas 2014\/24\/ES 20(1)p. paredz\u0113to izv\u0113les normu<\/i> ir iek\u013c\u0101vusi <b>vien\u012bgi attiec\u012bb\u0101 uz person\u0101m ar invalidit\u0101ti<\/b>. Direkt\u012bva paredz iesp\u0113ju noteikt, ka pas\u016bt\u012bt\u0101js var rezerv\u0113t \u0161\u0101das privile\u0123\u0113tas ties\u012bbas ar\u012b nelabv\u0113l\u012bg\u0101 situ\u0101cij\u0101 non\u0101ku\u0161\u0101m person\u0101m un \u201caizsarg\u0101t\u0101m darbn\u012bc\u0101m\u201d.<\/p>\n<p>PIL 16. panta 2. da\u013c\u0101 teikts, ka soci\u0101lajam uz\u0146\u0113mumam ir j\u0101atbilst \u0161\u0101d\u0101m paz\u012bm\u0113m:<\/p>\n<ul>\n<li>SIA;<\/li>\n<li>soci\u0101l\u0101 uz\u0146\u0113muma statuss (pie\u0161\u0137ir Labkl\u0101j\u012bbas ministrija);<\/li>\n<li>labv\u0113l\u012bgi soci\u0101lu ietekmi rado\u0161a saimniecisk\u0101 darb\u012bba \u2013 soci\u0101lo pakalpojumu snieg\u0161ana, izgl\u012bt\u012bbas veicin\u0101\u0161ana vai atbalsts zin\u0101tnei, vides aizsardz\u012bba un saglab\u0101\u0161ana, kult\u016bras daudzveid\u012bbas nodro\u0161in\u0101\u0161ana u.c.<\/li>\n<\/ul>\n<p>Soci\u0101l\u0101 uz\u0146\u0113muma stat\u016btos ietvertais m\u0113r\u0137is \u2013 m\u0113r\u0137a grupu nodarbin\u0101t\u012bba.<\/p>\n<p>Pas\u016bt\u012bt\u0101jam ir ties\u012bbas (iesp\u0113ja) rezerv\u0113t ties\u012bbas piedal\u012bties tikai <b>soci\u0101lajam uz\u0146\u0113mumam, ja l\u012bgums tiek sl\u0113gts par noteiktiem<\/b> soci\u0101liem, vesel\u012bbas, kult\u016bras jomas <b>pakalpojumiem<\/b>, piem\u0113ram:<\/p>\n<ul>\n<li> administrat\u012bvie, izgl\u012bt\u012bbas, vesel\u012bbas apr\u016bpes un m\u0101jok\u013cu pakalpojumi;<\/li>\n<li> m\u0101jsaimniec\u012bbu, apr\u016bpes, medic\u012bnisk\u0101 person\u0101la nodro\u0161in\u0101\u0161anas pakalpojumi;<\/li>\n<li> pirmsskolas, augst\u0101k\u0101s, pieaugu\u0161o izgl\u012bt\u012bbas un e-m\u0101c\u012bbu pakalpojumi;<\/li>\n<li> darbinieku m\u0101c\u012bbu pakalpojumi, m\u0101c\u012bbu telpas, m\u0101c\u012bbu konsult\u0101ciju pakalpojumi;<\/li>\n<li> bibliot\u0113ku, arh\u012bvu, muzeju un citi kult\u016bras pakalpojumi.<\/li>\n<\/ul>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Pas\u016bt\u012bt\u0101js ar vienu un to pa\u0161u soci\u0101lo uz\u0146\u0113mumu var sl\u0113gt vienu privile\u0123\u0113to l\u012bgumu tr\u012bs gadu laik\u0101.<\/span><\/b><\/p>\n<p>IUB apkopot\u0101 statistikas inform\u0101cija r\u0101da, ka, piem\u0113ram, 2016. gad\u0101 Latvij\u0101 pavisam nosl\u0113dza 15 449 publisko iepirkumu l\u012bgumus un visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s, bet nevienu privile\u0123\u0113to l\u012bgumu.<\/p>\n<p>P\u0113t\u012bjuma autore identific\u0113jusi probl\u0113mjaut\u0101jumu \u2013 vai privile\u0123\u0113to l\u012bgumu pas\u016bt\u012bt\u0101js var izv\u0113l\u0113ties sl\u0113gt l\u012bgumu ar\u012b \u201cmazajos iepirkumos\u201d jeb PIL 9. panta k\u0101rt\u012bb\u0101 organiz\u0113tajos iepirkumos.<\/p>\n<p>Autore secina \u2013 privile\u0123\u0113to l\u012bgumu pozit\u012bv\u0101 soci\u0101l\u0101 ietekme b\u016btu augst\u0101ka, ja pas\u016bt\u012bt\u0101ji b\u016btu vair\u0101k inform\u0113ti par iesp\u0113j\u0101m, k\u0101 un kad izmantot izdev\u012bbu \u0161\u0101dus l\u012bgumus sl\u0113gt.<\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Vienk\u0101r\u0161ota iepirkuma veik\u0161anas k\u0101rt\u012bba PIL 2. pielikuma pakalpojumiem<\/span><\/b><\/p>\n<p>PIL 10. pant\u0101 ir paredz\u0113ta vienk\u0101r\u0161ota (nav piem\u0113rojamas iepirkuma proced\u016bras, bet gan atsevi\u0161\u0137i PIL panti) iepirkumu veik\u0161anas k\u0101rt\u012bba PIL 2. pielikum\u0101 iek\u013cautiem pakalpojumiem, kuri cita starp\u0101 ietver vesel\u012bbas, soci\u0101los un saist\u012btos pakalpojumus.<\/p>\n<p>K. Gaigule-\u0160\u0101v\u0113ja v\u0113r\u0161 uzman\u012bbu \u2013 pas\u016bt\u012bt\u0101js var nepiem\u0113rot PIL 10. pantu, ja:<\/p>\n<p>l\u012bgums tiek sl\u0113gts par PIL 2. pielikuma sada\u013c\u0101 \u201cVesel\u012bbas, soci\u0101lie un saist\u012btie pakalpojumi\u201d min\u0113tajiem CPV kodiem un l\u012bgumcena ir maz\u0101ka par EUR 750 000.<\/p>\n<p>Pamatojums iz\u0146\u0113mumam \u2013 vesel\u012bbas un soci\u0101l\u0101s jomas normat\u012bvajos aktos daudziem pakalpojumiem ir noteiktas oblig\u0101ti piem\u0113rojam\u0101s izmaksu likmes (t\u0101tad pieg\u0101d\u0101t\u0101ji nekonkur\u0113 ar cenu) un izpildes standarti (pieg\u0101d\u0101t\u0101ji nekonkur\u0113 ar pied\u0101v\u0101juma apjomu un saturu), k\u0101 ar\u012b pakalpojumu sniedz\u0113ju bie\u017ei vien izv\u0113las tie\u0161i klients (izv\u0113rt\u0113jot attiec\u012bg\u0101 pakalpojumu sniedz\u0113ja reput\u0101ciju, sp\u0113ju sadarboties ar attiec\u012bgo speci\u0101listu (psiholo\u0123iskie faktori)), l\u012bdz ar to pas\u016bt\u012bt\u0101jam ir j\u0101ierobe\u017eo klientu izv\u0113le.
