Likumprojekti \u0161obr\u012bd ir izsludin\u0101ti Valsts sekret\u0101ru san\u0101ksm\u0113 saska\u0146o\u0161anai. P\u0113c tam tos j\u0101apstiprina Ministru kabinet\u0101 un Saeim\u0101. Visi pied\u0101v\u0101tie groz\u012bjumi nav vienl\u012bdz b\u016btiski. Ta\u010du da\u013ca no tiem ir atsevi\u0161\u0137as koment\u0113\u0161anas v\u0113rti.<\/p>\n<p>Pirmk\u0101rt, likumprojekt\u0101 noteikts pien\u0101kums pie noteiktas l\u012bgumcenas sasnieg\u0161anas <b>oblig\u0101ti r\u012bkot elektronisku apspriedi ar pieg\u0101d\u0101t\u0101jiem<\/b>. \u0160im nol\u016bkam pas\u016bt\u012bt\u0101jam ne \u0101tr\u0101k k\u0101 12 m\u0113ne\u0161us pirms iepirkuma izsludin\u0101\u0161anas publik\u0101ciju vad\u012bbas sist\u0113m\u0101 b\u016bs j\u0101public\u0113 pazi\u0146ojums par elektronisko apspriedi, k\u0101 ar\u012b kvalifik\u0101cijas pras\u012bbas un tehnisk\u0101s specifik\u0101cijas. Pas\u016bt\u012bt\u0101jam b\u016bs pien\u0101kums dot pieg\u0101d\u0101t\u0101jiem vismaz 10 darba dienas laika koment\u0113\u0161anai, k\u0101 ar\u012b dokument\u0113t sa\u0146emtos koment\u0101rus par kvalifik\u0101cijas pras\u012bb\u0101m un tehniskaj\u0101m specifik\u0101cij\u0101m, nor\u0101dot pamatojumu, ja koment\u0101ri netiek \u0146emti v\u0113r\u0101.<br \/>\n<!--more--><br \/>\nAc\u012bmredzot, \u0161o groz\u012bjumu m\u0113r\u0137is ir gan paaugstin\u0101t iepirkuma dokumentu kvalit\u0101ti, gan nov\u0113rst konkurences krop\u013co\u0161anu, k\u0101da var rasties nepamatotu pras\u012bbu gad\u012bjum\u0101. Pien\u0101kums r\u012bkot elektronisk\u0101s apspriedes ir paredz\u0113ts papildus jau \u0161obr\u012bd pas\u016bt\u012btajiem piem\u012bto\u0161aj\u0101m ties\u012bb\u0101m r\u012bkot apspriedes ar pieg\u0101d\u0101t\u0101jiem. At\u0161\u0137ir\u012bba ir apst\u0101kl\u012b, ka \u0161obr\u012bd likum\u0101 noteikt\u0101 apspriede ar pieg\u0101d\u0101t\u0101jiem nav oblig\u0101ta, savuk\u0101rt elektronisko apspriedi pl\u0101nots noteikt k\u0101 oblig\u0101tu tad, ja l\u012bgumcena sasniegs konkr\u0113tu, pagaid\u0101m nezin\u0101mu, robe\u017eu.<\/p>\n<p>\u0160is groz\u012bjums ir atbalst\u0101ms, jo nereti iepirkumos ir nov\u0113rojamas l\u012bdz galam neizskaidrojamas pras\u012bbas, par ko pieg\u0101d\u0101t\u0101ji uzzina tikai tad, ka iepirkums ir izsludin\u0101ts. Da\u017ek\u0101rt t\u0101s var b\u016bt ar\u012b kompetences tr\u016bkuma sekas. \u0100tr\u0101ka inform\u0101cijas ieg\u016b\u0161ana par iecer\u0113taj\u0101m kvalifik\u0101cijas pras\u012bb\u0101m un tehnisko specifik\u0101ciju v\u0113rt\u0113jama pozit\u012bvi, jo dotu iesp\u0113ju pieg\u0101d\u0101t\u0101jiem savlaic\u012bgi nor\u0101d\u012bt pas\u016bt\u012bt\u0101jam uz pras\u012bbu d\u012bvain\u012bb\u0101m, k\u0101 ar\u012b ieteikt uzlabojumus gan kvalifik\u0101cijas pras\u012bb\u0101s, gan tehniskaj\u0101 specifik\u0101cij\u0101, k\u0101 tas jau \u0161obr\u012bd ir nov\u0113rojams tajos gad\u012bjumos, kad pas\u016bt\u012bt\u0101ji r\u012bko apspriedes ar pieg\u0101d\u0101t\u0101jiem eso\u0161\u0101 tiesisk\u0101 regul\u0113juma ietvaros.<\/p>\n<p>Tom\u0113r j\u0101nor\u0101da, ka likumprojekts neparedz tiesiskas sekas tad, ja elektronisk\u0101 apspriede netiek sar\u012bkota, kaut ar\u012b tai bija j\u0101notiek, k\u0101 ar\u012b \u2013 ja pas\u016bt\u012bt\u0101js nemotiv\u0113ti ne\u0146em v\u0113r\u0101 pieg\u0101d\u0101t\u0101ju koment\u0101rus. Likumprojekta kontekst\u0101 \u0161os jaut\u0101jumus b\u016btu j\u0101izdiskut\u0113. Ja elektronisk\u0101s apspriedes nesar\u012bko\u0161ana neietekm\u0113s iepirkuma proced\u016bras norisi, ideja par kvalifik\u0101cijas pras\u012bbu un tehnisk\u0101s specifik\u0101cijas apsprie\u0161anu pirms iepirkuma izsludin\u0101\u0161anas netiks \u012bstenota efekt\u012bvi.<\/p>\n<p>Otrk\u0101rt, noteikts pien\u0101kums atkl\u0101t\u0101 konkurs\u0101, sl\u0113gt\u0101 konkurs\u0101 vai konkursa proced\u016br\u0101 ar sarun\u0101m pieg\u0101d\u0101t\u0101ju <b>konkurences neesam\u012bbas gad\u012bjum\u0101 (ja iesniegts tikai viens pied\u0101v\u0101jums) p\u0101rtraukt iepirkuma proced\u016bru<\/b>, iz\u0146emot, ja iepirkuma proced\u016bras p\u0101rtrauk\u0161ana apdraud sabiedr\u012bbas dro\u0161\u012bbas vai vesel\u012bbas aizsardz\u012bbas intereses.<\/p>\n<p>\u0160is groz\u012bjums, ja tiks pie\u0146emts, praks\u0113 var\u0113tu rad\u012bt gr\u016bt\u012bbas. Piem\u0113ram, tam par iemeslu var b\u016bt l\u012bguma neliels apjoms, kas neinteres\u0113 pla\u0161u pieg\u0101d\u0101t\u0101ju loku, vai projekta realiz\u0113\u0161anai nepiecie\u0161am\u0101s specifisk\u0101s zin\u0101\u0161anas vai kompetences, k\u0101das Latvijas pieg\u0101d\u0101t\u0101jiem nepiem\u012bt. Sapr\u0101t\u012bga interpret\u0101cija b\u016btu, ka iepirkuma komisijai pirms iepirkuma izsludin\u0101\u0161anas ir pien\u0101kums izv\u0113rt\u0113t tehnisko specifik\u0101ciju aktualit\u0101ti, bet groz\u012bjumus taj\u0101s j\u0101veic tikai tad, ja tiek konstat\u0113ts, ka tehnisk\u0101 specifik\u0101cija vairs nav aktu\u0101la. Pa\u0161laik tiek pied\u0101v\u0101tas: projekt\u0113\u0161ana, apvienot\u0101 projekt\u0113\u0161ana un b\u016bvdarbi, elektroener\u0123iju pat\u0113r\u0113jo\u0161as preces un autotransporta l\u012bdzek\u013ci. \u0160\u012b groz\u012bjuma m\u0113r\u0137is ir skaidrs \u2013 veicin\u0101t atteik\u0161anos no cenas k\u0101 pied\u0101v\u0101jumu sal\u012bdzin\u0101\u0161anas un v\u0113rt\u0113\u0161anas vien\u012bg\u0101 krit\u0113rija.<\/p>\n<p>M\u0113r\u0137is ir atbalst\u0101ms. 2014. gada Eiropas Savien\u012bbas publisko iepirkumu direkt\u012bvu viens no m\u0113r\u0137iem ir tie\u0161i t\u0101ds \u2013 cenas viet\u0101 arvien vair\u0101k v\u0113rt\u0113t saimniecisko izdev\u012bgumu. Ta\u010du no juridisk\u0101s tehnikas viedok\u013ca ir ap\u0161aub\u0101ms, vai \u0161o m\u0113r\u0137i var\u0113s sasniegt, likum\u0101 nosakot konkr\u0113tas pre\u010du un pakalpojumu grupas, kur\u0101s pied\u0101v\u0101jumu sal\u012bdzin\u0101\u0161anai un izv\u0113rt\u0113\u0161anai nedr\u012bkst izmantot tikai cenu, jo \u2013 k\u0101 n\u0101kotn\u0113 likumu att\u012bst\u012bt t\u0101l\u0101k?
