Groz\u012bjumu m\u0113r\u0137is ir pan\u0101kt atkl\u0101t\u012bbas un god\u012bgas konkurences veicin\u0101\u0161anu iepirkumos, k\u0101 ar\u012b paaugstin\u0101t iepirkumu sagatavo\u0161anas kvalit\u0101ti. Ar pl\u0101notaj\u0101m izmai\u0146\u0101m iecer\u0113ts pilnveidot PIL regul\u0113jumu, pied\u0101v\u0101jot risin\u0101jumu vair\u0101k\u0101m p\u0113d\u0113j\u0101 laik\u0101 ar\u012b publiskaj\u0101 telp\u0101 aktualiz\u0113t\u0101m probl\u0113m\u0101m publisko iepirkumu noris\u0113. Protams, nav iesp\u0113jams atrast vienu univers\u0101lu risin\u0101jumu m\u0113r\u0137a sasnieg\u0161anai, turkl\u0101t j\u0101\u0146em v\u0113r\u0101, ka iepirkumu norises kvalit\u0101tes paaugstin\u0101\u0161ana ne vienm\u0113r atvieglos darbu pas\u016bt\u012bt\u0101jiem vai pa\u0101trin\u0101s iepirkumu norisi. B\u016btiski ir main\u012bt izpratni par iepirkuma noz\u012bmi, jo iepirkums nav tikai l\u012bdzeklis finans\u0113juma izt\u0113r\u0113\u0161anai, pret\u012b ieg\u016bstot k\u0101das noteiktas preces, pakalpojumus vai b\u016bvdarbus. Iepirkumam pak\u0101peniski ir j\u0101k\u013c\u016bst par strat\u0113\u0123isku l\u012bdzekli, ar kuru \u012bstenot nozaru politikas, stimul\u0113t zin\u0101tnes, ra\u017eo\u0161anas un tirgus att\u012bst\u012bbu kopum\u0101, t\u0101d\u0113j\u0101di veicinot inov\u0101cijas, un energoefekt\u012bvu un videi draudz\u012bgu risin\u0101jumu arvien pla\u0161\u0101ku izmanto\u0161anu.<\/b><\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Nepiecie\u0161am\u012bba uzlabot publisko iepirkumu norisi<\/span><\/b><\/p>\n<p>Eiropas Komisijas 2018. gada zi\u0146ojum\u0101 par Latviju<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup> secin\u0101ts, ka Latvijai joproj\u0101m ir v\u0101ji rezult\u0101ti publisko iepirkumu jom\u0101, ko rada konkurences, atkl\u0101tuma probl\u0113mas un korupcijas riski iepirkumu proces\u0101. Konkurences padome, v\u0113r\u0161ot uzman\u012bbu uz rakstur\u012bg\u0101kajiem tr\u016bkumiem konkurences uzraudz\u012bb\u0101 2018. gad\u0101<sup><a href=\"#fn2\" id=\"ref1\">2<\/a><\/sup>, ir izc\u0113lusi iepirkumu karte\u013cus k\u0101 vienu no konkurences vides galvenajiem riskiem. Savuk\u0101rt viena no b\u016btisk\u0101kaj\u0101m ar konkurences neesam\u012bbu saist\u012btaj\u0101m probl\u0113m\u0101m, uz ko vair\u0101kk\u0101rt sav\u0101s publik\u0101cij\u0101s cita starp\u0101 ir nor\u0101d\u012bjusi ar\u012b Sabiedr\u012bba par atkl\u0101t\u012bbu \u201cDelna\u201d, ir iev\u0113rojamais t\u0101du publisko iepirkumu skaits, kuros tiek iesniegts tikai viens pied\u0101v\u0101jums vai pieteikums. Piem\u0113ram, k\u0101 r\u0101da Iepirkumu uzraudz\u012bbas biroja (IUB) sniegto datu anal\u012bze, ar ko s\u012bk\u0101k iesp\u0113jams iepaz\u012bties likumprojekta anot\u0101cij\u0101, viens pieg\u0101d\u0101t\u0101js bez konkurences piedal\u012bjies 20% iepirkuma proced\u016bru 2017. gad\u0101, bet 2018. gad\u0101 \u0161is r\u0101d\u012bt\u0101js pieaudzis l\u012bdz 25%<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup>.<br \/>\n<!--more--><br \/>\nFaktisk\u0101 konkurences neesam\u012bba starp pieg\u0101d\u0101t\u0101jiem, k\u0101 ar\u012b publiskaj\u0101 telp\u0101 un p\u0113d\u0113jo gadu publisko iepirkumu profesion\u0101\u013cu konferenc\u0113s un citos forumos paustais kontrol\u0113jo\u0161o instit\u016bciju un ekspertu viedoklis liecina par to, ka pras\u012bbas iepirkumos tiek formul\u0113tas t\u0101, ka t\u0101s sp\u0113j izpild\u012bt \u0161aurs pieg\u0101d\u0101t\u0101ju loks, kas savuk\u0101rt nor\u0101da uz nepamatotu un ierobe\u017eojo\u0161u pras\u012bbu izvirz\u012b\u0161anu. Proti, iepirkuma dokument\u0101cij\u0101 nepamatoti dodot priek\u0161roc\u012bbas vai izvirzot labv\u0113l\u012bg\u0101kus noteikumus vienam pieg\u0101d\u0101t\u0101jam, tiek pan\u0101kts, ka citi pieg\u0101d\u0101t\u0101ji neiesniedz pieteikumus vai pied\u0101v\u0101jumus, radot ierobe\u017eotas konkurences apst\u0101k\u013cus. V\u0113rt\u0113jot iepirkuma dokumentu praksi, nereti secin\u0101ms, ka pastiprin\u0101ta uzman\u012bba tiek piev\u0113rsta stingru un detaliz\u0113tu kvalifik\u0101cijas pras\u012bbu noteik\u0161anai, maz\u0101ku uzman\u012bbu veltot tehnisko specifik\u0101ciju un iepirkuma l\u012bguma kvalitat\u012bvai izstr\u0101dei, k\u0101 ar\u012b galvenok\u0101rt par vien\u012bgo pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas krit\u0113riju tiek izmantota zem\u0101k\u0101 cena.<br \/>\n<!--more--><br \/>\nMin\u0113t\u0101s indik\u0101cijas nor\u0101da uz vair\u0101k\u0101m b\u016btisk\u0101m probl\u0113m\u0101m publisko iepirkumu noris\u0113, \u013caujot secin\u0101t, ka aizvien bie\u017e\u0101k faktiskaj\u0101 publisk\u0101 iepirkuma proces\u0101 netiek sasniegts PIL noteiktais m\u0113r\u0137is \u2013 iepirkumu atkl\u0101tums, pieg\u0101d\u0101t\u0101ju br\u012bva konkurence, vienl\u012bdz\u012bga un taisn\u012bga attieksme pret tiem, pas\u016bt\u012bt\u0101ja l\u012bdzek\u013cu efekt\u012bva izmanto\u0161ana. L\u012bdz ar to, lai veicin\u0101tu publisko iepirkumu norises kvalit\u0101tes uzlabo\u0161anu, ir nepiecie\u0161ams veikt groz\u012bjumus tiesiskaj\u0101 regul\u0113jum\u0101.<\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Iepirkuma proced\u016bras dokument\u0101cijas kvalit\u0101tes paaugstin\u0101\u0161ana<\/span><\/b><\/p>\n<p>Tirgus izp\u0113tes veik\u0161ana un pieg\u0101d\u0101t\u0101ju iesp\u0113ju konkurences apst\u0101k\u013cos nodro\u0161in\u0101t pas\u016bt\u012bt\u0101ja vajadz\u012bbas noskaidro\u0161ana ir \u0161\u0137ietami pa\u0161saprotams iepirkuma sagatavo\u0161anas posms. Tirgus izp\u0113tes ietvaros tiek apzin\u0101ts iesp\u0113jamais pieg\u0101d\u0101t\u0101ju loks, objekt\u012bvi noteikta paredzam\u0101 l\u012bgumcena, vienlaikus samazinot risku iepirkuma dokument\u0101cij\u0101 iek\u013caut nepamatotus ierobe\u017eojumus. T\u0101s rezult\u0101t\u0101 tiek sagatavotas pras\u012bbas pieg\u0101d\u0101t\u0101jiem un iepirkuma priek\u0161metam, saska\u0146\u0101 ar kur\u0101m sagatavojami pied\u0101v\u0101jumi un veicama pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161ana. Diem\u017e\u0113l \u0161\u012b posma noz\u012bme bie\u017ei tiek nov\u0113rt\u0113ta p\u0101r\u0101k zemu, k\u0101 rezult\u0101t\u0101 nereti gan iepirkuma norise, gan iepirkuma rezult\u0101ts ir nelietder\u012bgs un neefekt\u012bvs.<\/p>\n<p>Ar groz\u012bjumiem tiek pl\u0101nots noteikt pien\u0101kumu pie konkr\u0113tas l\u012bgumcenas pirms iepirkuma izsludin\u0101\u0161anas r\u012bkot elektronisku apspriedi ar pieg\u0101d\u0101t\u0101jiem. T\u0101 tiks nodro\u0161in\u0101ts, ka pirms iepirkuma s\u0101k\u0161anas ir veikta tirgus izp\u0113te un noskaidrotas gan pieg\u0101d\u0101t\u0101ju iesp\u0113jas konkurences apst\u0101k\u013cos nodro\u0161in\u0101t pas\u016bt\u012bt\u0101ja vajadz\u012bbas, gan iesp\u0113jami lab\u0101kie tirgus pied\u0101v\u0101tie risin\u0101jumi \u0161\u012bm vajadz\u012bb\u0101m. Lai ar\u012b sagaid\u0101ms, ka daudzi pas\u016bt\u012bt\u0101ji uzskat\u012bs, ka \u0161\u0101du tirgus konsult\u0101ciju veik\u0161ana paildzin\u0101s iepirkuma proced\u016bras norisi, tom\u0113r j\u0101\u0146em v\u0113r\u0101, ka iepirkuma proced\u016bras norisi vair\u0101k paildzina iepirkuma p\u0101rtrauk\u0161ana vai ar\u012b iepirkuma proced\u016bras dokumentos noteikto pras\u012bbu vai rezult\u0101tu apstr\u012bd\u0113\u0161ana IUB, un tam c\u0113lonis nereti ir tie\u0161i nekvalitat\u012bvi sagatavoti iepirkuma proced\u016bras dokumenti.<\/p>\n<p>T\u0101pat ar groz\u012bjumiem pl\u0101nots noteikt pien\u0101kumu aktualiz\u0113t tehnisk\u0101s specifik\u0101cijas, kas izstr\u0101d\u0101tas vair\u0101k nek\u0101 pirms gada, nepie\u013caujot, ka iepirkuma dokumentos tiek ietvertas iev\u0113rojamu laika periodu pirms iepirkuma izsludin\u0101\u0161anas sagatavotas tehnisk\u0101s specifik\u0101cijas. T\u0101d\u0113j\u0101di ir pl\u0101nots veicin\u0101t to, lai iepirkuma izsludin\u0101\u0161anas br\u012bd\u012b tiktu maksim\u0101li prec\u012bzi noteikta paredzam\u0101 l\u012bgumcena un tehnisk\u0101s specifik\u0101cijas b\u016btu aktu\u0101las un normat\u012bvajiem aktiem atbilsto\u0161as. Paredzams, ka tas mazin\u0101s iesp\u0113jam\u012bbu, ka tikai iepirkuma laik\u0101, kad jau izt\u0113r\u0113ti b\u016btiski pas\u016bt\u012bt\u0101ja administrat\u012bvie un laika resursi iepirkuma sagatavo\u0161anai, izsludin\u0101\u0161anai un pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas uzs\u0101k\u0161anai, k\u0101 ar\u012b pieg\u0101d\u0101t\u0101ju resursi pied\u0101v\u0101jumu sagatavo\u0161anai,  pas\u016bt\u012bt\u0101js konstat\u0113 nepietiekamu finans\u0113jumu l\u012bguma izpildei vai ar\u012b pied\u0101v\u0101to risin\u0101jumu neatbilst\u012bbu normat\u012bvu pras\u012bb\u0101m, piem\u0113ram, ja main\u012bju\u0161ies b\u016bvnormat\u012bvi. Ar\u012b pras\u012bbu aktualiz\u0113\u0161ana pirms iepirkuma izsludin\u0101\u0161anas ir \u0161\u0137ietami pa\u0161saprotama darb\u012bba katra iepirkuma sagatavo\u0161an\u0101. Tom\u0113r praks\u0113 diem\u017e\u0113l tiek konstat\u0113ts, ka iepirkumos izvirz\u0101m\u0101s pras\u012bbas nereti ir tiku\u0161as p\u0101rskat\u012btas un aktualiz\u0113tas vair\u0101kus gadus pirms iepirkuma izsludin\u0101\u0161anas, k\u0101 rezult\u0101t\u0101 iest\u0101jas gan iepriek\u0161 min\u0113t\u0101s probl\u0113mas, gan ar\u012b nepiecie\u0161am\u012bba v\u0113l\u0101k groz\u012bt nosl\u0113gto iepirkuma l\u012bgumu. L\u012bdz ar to nereti pagarin\u0101s l\u012bguma izpildes termi\u0146\u0161 un ar\u012b sad\u0101rdzin\u0101s t\u0101 izpilde.<\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Paaugstin\u0101ta iepirkumu veic\u0113ju atbild\u012bba par iepirkumu norisi<\/span><\/b><\/p>\n<p>Lai veicin\u0101tu iepirkuma komisijas darba kvalit\u0101tes uzlabo\u0161anu, vienlaikus samazinot korupcijas riskus, un pastiprin\u0101tu pas\u016bt\u012bt\u0101ju atbild\u012bbu par t\u0101s izveidi, ar groz\u012bjumiem pl\u0101nots pilnveidot noteikumus iepirkuma komisijas izveidei un darb\u012bbai. Svar\u012bg\u0101k\u0101s izmai\u0146as skars iepirkuma komisijas izveides nosac\u012bjumus, atsakoties no past\u0101v\u012bgi funkcion\u0113jo\u0161\u0101m vai uz ilgu laiku izveidot\u0101m iepirkumu komisij\u0101m, t\u0101d\u0113j\u0101di radot nepiecie\u0161am\u012bbu pas\u016bt\u012bt\u0101jam bie\u017e\u0101k izv\u0113rt\u0113t iepirkumu komisiju sast\u0101vos iek\u013cauto locek\u013cu atbilst\u012bbu. Ar groz\u012bjumiem ar\u012b paredz\u0113ts regul\u0113t iepirkuma komisijas sekret\u0101ra l\u012bdz \u0161im nenoteikto darb\u012bbu un lomu iepirkuma komisij\u0101.<\/p>\n<p><b><span style=\"color: #2d5986; font-size: medium;\">Ierobe\u017eota iesp\u0113ja nosl\u0113gt iepirkuma l\u012bgumu pieg\u0101d\u0101t\u0101ju konkurences neesam\u012bbas d\u0113\u013c<\/span><\/b><\/p>\n<p>\u0145emot v\u0113r\u0101 to, ka p\u0113d\u0113jos gados ir iev\u0113rojami pieaudzis t\u0101du iepirkumu skaits, kuros ir iesniegts viens pied\u0101v\u0101jums vai pieteikums, ir nepiecie\u0161ams rosin\u0101t pas\u016bt\u012bt\u0101jus efekt\u012bv\u0101k izmantot visus pieejamos l\u012bdzek\u013cus pieg\u0101d\u0101t\u0101ju konkurences nodro\u0161in\u0101\u0161anai. L\u012bdz ar to likumprojekts paredz pien\u0101kumu pas\u016bt\u012bt\u0101jiem p\u0101rtraukt iepirkuma proced\u016bru, ja taj\u0101 iesniegts tikai viens pieteikums vai pied\u0101v\u0101jums. Regul\u0113juma prim\u0101rais m\u0113r\u0137is nav kav\u0113t iepirkuma l\u012bgumu nosl\u0113g\u0161anu, bet gan rad\u012bt re\u0101lu nepiecie\u0161am\u012bbu pas\u016bt\u012bt\u0101jiem veikt r\u016bp\u012bgu tirgus izp\u0113ti, nodro\u0161in\u0101t, ka pas\u016bt\u012bt\u0101ji t\u0101 viet\u0101, lai paredz\u0113tu konkurenci ierobe\u017eojo\u0161as atlases pras\u012bbas, koncentr\u0113jas uz funkcion\u0101lu, m\u0113r\u0137tiec\u012bgi veidotu tehnisko specifik\u0101ciju sagatavo\u0161anu, izvairoties no priek\u0161rokas do\u0161anas konkr\u0113tu pieg\u0101d\u0101t\u0101ju vai z\u012bmolu produktiem. Vienlaikus \u0161\u0101ds regul\u0113jums sekm\u0113s ar\u012b to, lai lab\u0101k\u0101 pied\u0101v\u0101juma izv\u0113l\u0113 tiktu piem\u0113roti ar\u012b citi saimnieciski visizdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma noteik\u0161anas krit\u0113riji, nevis tikai zem\u0101k\u0101 cena, t\u0101d\u0113j\u0101di atverot iesp\u0113jas pla\u0161\u0101kai konkurencei un ar\u012b inovat\u012bvu risin\u0101jumu pied\u0101v\u0101\u0161anai.<\/p>\n<p>Pak\u0101peniska atteik\u0161an\u0101s no zem\u0101k\u0101s cenas k\u0101 vien\u012bg\u0101 krit\u0113rija izv\u0113rt\u0113\u0161anas<br \/>\nSp\u0113k\u0101 eso\u0161ais regul\u0113jums pied\u0101v\u0101 pla\u0161as iesp\u0113jas saimnieciski visizdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma noteik\u0161anai, tom\u0113r praks\u0113 absol\u016btaj\u0101 vair\u0101kum\u0101 gad\u012bjumu k\u0101 vien\u012bgais pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113rijs tiek piem\u0113rota zem\u0101k\u0101 cena.
