Ja l\u012bgums nosl\u0113gts neatbilsto\u0161\u0101 iepirkuma proced\u016br\u0101 vai \u0161\u0101du proced\u016bru ner\u012bkojot visp\u0101r, ties\u012bbas pras\u012bt \u0161\u0101da l\u012bguma atz\u012b\u0161anu par sp\u0113k\u0101 neeso\u0161u nav pamatojamas ar personas dal\u012bbu l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas proced\u016br\u0101, jo \u0161\u0101das proced\u016bras nav, vai t\u0101 ir pieejama ierobe\u017eotam personu lokam. T\u0101d\u0101 gad\u012bjum\u0101 personas ties\u012bbas iesniegt pieteikumu var pamatot, piem\u0113ram, apst\u0101klis, ka t\u0101s pamatdarb\u012bba saist\u012bta ar l\u012bgum\u0101 paredz\u0113to pakalpojumu snieg\u0161anu, k\u0101 ar\u012b apst\u0101klis, ka t\u0101 jau pas\u016bt\u012bt\u0101jam sniegusi l\u012bdz\u012bgus pakalpojumus. Papildus min\u0113tajam AT nor\u0101d\u012bjusi, ka, t\u0101 k\u0101 b\u016btisku groz\u012bjumu veik\u0161ana iepirkuma l\u012bgum\u0101 piel\u012bdzin\u0101ma jauna l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anai, tad pret \u0161\u0101diem groz\u012bjumiem var iebilst t\u0101d\u0101 pa\u0161\u0101 k\u0101rt\u012bb\u0101, k\u0101d\u0101 var pras\u012bt atz\u012bt par sp\u0113k\u0101 neeso\u0161u iepirkuma l\u012bgumu. AT nor\u0101d\u012bjusi, ka, at\u0161\u0137ir\u012bb\u0101 no lietas Nr.SKA-853\/2010, kur\u0101 secin\u0101ts, ka apak\u0161uz\u0146\u0113m\u0113jam nav subjekt\u012bvo ties\u012bbu iebilst pret l\u012bguma groz\u012bjumiem, \u0161aj\u0101 liet\u0101 pieteic\u0113js v\u0113las aizsarg\u0101t t\u0101du interesi, kas tai piem\u012bt neatkar\u012bgi no t\u0101s apak\u0161uz\u0146\u0113m\u0113jas statusa s\u0101kotn\u0113j\u0101 iepirkum\u0101. (20.02.2018. SKA-932\/2018). Cit\u0101 liet\u0101 pieg\u0101d\u0101t\u0101js iebilda pret to, ka pas\u016bt\u012bt\u0101js nevis sl\u0113dza visp\u0101r\u012bgo vieno\u0161anos, bet uzreiz iepirkuma l\u012bgumu, uzskatot tos par l\u012bguma groz\u012bjumiem. Tom\u0113r par l\u012bguma groz\u012bjumiem var run\u0101t vien\u012bgi tad, ja l\u012bgums faktiski ir groz\u012bts, t.i., ja s\u0101kotn\u0113j\u0101 nosl\u0113gt\u0101 l\u012bguma redakcija, kuras projekts bija pieejams vis\u0101m ieinteres\u0113taj\u0101m person\u0101m, at\u0161\u0137iras no v\u0113l\u0101k\u0101s l\u012bguma redakcijas, bet konkr\u0113tie apst\u0101k\u013ci par to neliecina. Vienlaikus AT atzina, ka apst\u0101klis, ka nosl\u0113gtais l\u012bgums b\u016btiski at\u0161\u0137iras no iepirkuma rezult\u0101t\u0101 pie\u0146emtaj\u0101 l\u0113mum\u0101 paredz\u0113t\u0101, var b\u016bt pamats atz\u012bt l\u012bgumu par sp\u0113k\u0101 neeso\u0161u saska\u0146\u0101 ar PIL 74(1)1. (28.05.2018. <b>SKA-1103\/2018<\/b>)<\/p>\n<p><b>Pagaidu aizsardz\u012bba: <\/b>Atbilsto\u0161i Administrat\u012bv\u0101 procesa likuma (APL) 185. un 195. pantam pagaidu aizsardz\u012bbas l\u012bdzek\u013cu piem\u0113ro\u0161anas pamats ir divu kumulat\u012bvu krit\u0113riju iest\u0101\u0161an\u0101s: pirmk\u0101rt, tiesas konstat\u0113jums, ka tad, ja \u0161ie l\u012bdzek\u013ci netiktu piem\u0113roti, var\u0113tu rasties b\u016btisks kait\u0113jums vai zaud\u0113jumi, kuru nov\u0113r\u0161ana vai atl\u012bdzin\u0101\u0161ana b\u016btu iev\u0113rojami apgr\u016btin\u0101ta vai pras\u012btu nesam\u0113r\u012bgus resursus (subjekt\u012bvais krit\u0113rijs), un, otrk\u0101rt, secin\u0101jums, ka p\u0101rs\u016bdz\u0113t\u0101 iest\u0101des r\u012bc\u012bba (administrat\u012bvais akts, faktisk\u0101 r\u012bc\u012bba, nosl\u0113gtais l\u012bgums) ir pirm\u0161\u0137ietami prettiesiska. (23.03.2018. <b>SKA-1060\/2018<\/b>) Attiec\u012bb\u0101 uz ties\u012bb\u0101m pras\u012bt pagaidu aizsardz\u012bbu AT noraid\u012bja pas\u016bt\u012bt\u0101ja argumentu, ka pieteic\u0113jas interese ir p\u0101r\u0101k att\u0101lin\u0101ta, jo tai neesot tehnisk\u0101s iesp\u0113jas sniegt str\u012bdus pakalpojumus. Ja iepirkums visp\u0101r nav izsludin\u0101ts, b\u016btu p\u0101rm\u0113r\u012bgi pras\u012bt, lai personai (kurai, \u0146emot v\u0113r\u0101, piem\u0113ram, t\u0101s darb\u012bbas jomu, ir interese attiec\u012bg\u0101 veida pakalpojumu snieg\u0161an\u0101) jau lietas izskat\u012b\u0161anas laik\u0101 b\u016btu sag\u0101d\u0101ti visi nepiecie\u0161amie resursi pakalpojumu nodro\u0161in\u0101\u0161anai. AT ar\u012b atk\u0101rtoti nor\u0101d\u012bja, ka tiesiskums pats par sevi demokr\u0101tisk\u0101 valst\u012b ir aizsarg\u0101jama v\u0113rt\u012bba, un nepamatota konkurencei atv\u0113rtas proced\u016bras nepiem\u0113ro\u0161ana ir vissmag\u0101kais p\u0101rk\u0101pums publisk\u0101 iepirkuma un koncesijas l\u012bguma nosl\u0113g\u0161anas proces\u0101, t\u0101pat k\u0101 nelikum\u012bga l\u012bguma pagarin\u0101\u0161ana, kas piel\u012bdzin\u0101ma tie\u0161ai l\u012bguma nosl\u0113g\u0161anai. (12.02.2018. <b>SKA-903\/2018<\/b>) Par pagaidu aizsardz\u012bbas piem\u0113ro\u0161anas efektivit\u0101ti AT nor\u0101d\u012bjusi, ka tas ir instruments, kas \u013cauj nodro\u0161in\u0101t, ka tad, kad persona ties\u0101 v\u0113rsusies pirm\u0161\u0137ietami pamatoti un apst\u0101k\u013ci prasa steidzamu risin\u0101jumu, lietas izskat\u012b\u0161anas ilgums nekav\u0113 taisn\u012bguma atjauno\u0161anu. T\u0101p\u0113c <b>tiesai ir akt\u012bvs pien\u0101kums raudz\u012bties, lai jaut\u0101jums par pagaidu aizsardz\u012bbas l\u012bdzek\u013cu piem\u0113ro\u0161anu tiktu izlemts \u0101tri un efekt\u012bvi, maksim\u0101li nov\u0113r\u0161ot iesp\u0113jam\u012bbu, ka lietas izskat\u012b\u0161anas ilguma d\u0113\u013c ties\u012bbu aizsk\u0101rums, kura d\u0113\u013c persona v\u0113rsusies ties\u0101, k\u013c\u016bst neatgriezenisks. <\/b>Tostarp tiesa var aicin\u0101t pas\u016bt\u012bt\u0101ju attur\u0113ties no l\u012bguma nosl\u0113g\u0161anas l\u012bdz br\u012bdim, kam\u0113r tiek izskat\u012bts iesniegtais pagaidu aizsardz\u012bbas l\u016bgums. (29.06.2018. <b>SKA-1320\/2018<\/b>)<\/p>\n<p><b>Zaud\u0113jumu atl\u012bdzin\u0101\u0161ana:<\/b> Izv\u0113rt\u0113jot, vai pras\u012bjumam par zaud\u0113jumu atl\u012bdzin\u0101jumu iepirkumu liet\u0101s ir paredz\u0113ta lietas \u0101rpustiesas izskat\u012b\u0161anas k\u0101rt\u012bba, AT nor\u0101d\u012bjusi, ka bez APL uz publiskajiem iepirkumiem attiecas ar\u012b PIL, kas ir speci\u0101ls regul\u0113jums iepretim APL, t\u0101d\u0113\u013c <b>APL normas ir piem\u0113rojamas tikt\u0101l, cik PIL attiec\u012bgo jaut\u0101jumu nenoregul\u0113 at\u0161\u0137ir\u012bgi, un \u0161aj\u0101 gad\u012bjum\u0101 nav j\u0101iev\u0113ro \u0101rpustiesas izskat\u012b\u0161anas k\u0101rt\u012bba.<\/b> (09.03.2018. <b>SKA-1034\/2018<\/b>) T\u0101pat AT atk\u0101rtojusi, ka aizsardz\u012bbas v\u0113rta ir personu interese piedal\u012bties tiesisk\u0101 iepirkuma proced\u016br\u0101 pati par sevi, un t\u0101s aizsardz\u012bbu neb\u016btu iesp\u0113jams efekt\u012bvi nodro\u0161in\u0101t, ja katr\u0101 pagaidu aizsardz\u012bbas l\u016bguma gad\u012bjum\u0101 tiesa piepras\u012btu pier\u0101d\u012bjumus par re\u0101liem zaud\u0113jumiem, kas personai var\u0113tu rasties pas\u016bt\u012bt\u0101ja prettiesisk\u0101 l\u0113muma d\u0113\u013c. Ar APL paredz\u0113tajiem pier\u0101d\u012b\u0161anas l\u012bdzek\u013ciem nav iesp\u0113jams pier\u0101d\u012bt konkr\u0113tus mantisk\u0101 izteiksm\u0113 izsak\u0101mus zaud\u0113jumus, kas rastos, ja pretendents prettiesiska l\u0113muma d\u0113\u013c nevar\u0113tu pretend\u0113t uz l\u012bguma sl\u0113g\u0161anas ties\u012bb\u0101m. (12.02.2018. <b>SKA-903\/2018<\/b>) Apst\u0101klis, ka nav pier\u0101d\u012bta konkr\u0113ta zaud\u0113jumu ra\u0161an\u0101s iesp\u0113ja, nenoz\u012bm\u0113, ka nav \u012bstenojies subjekt\u012bvais krit\u0113rijs, un ir j\u0101p\u0101rbauda ar\u012b otra \u2013 objekt\u012bv\u0101 krit\u0113rija \u2013 \u012bsteno\u0161an\u0101s. (21.05.2018. <b>SKA-1222\/2018<\/b>) Savuk\u0101rt cit\u0101 liet\u0101 pas\u016bt\u012bt\u0101ja nor\u0101de, ka atz\u012bstot l\u012bgumus par sp\u0113k\u0101 neeso\u0161iem, nevienam neiest\u0101tos sekas, jo pakalpojumi jau ir sniegti, AT ieskat\u0101 izgaismo vienu no publisko iepirkumu tiesisk\u0101 regul\u0113juma efektivit\u0101tes probl\u0113m\u0101m. Ja uz p\u0101rk\u0101pumu pamata pakalpojumu iepirkuma l\u012bgums tiek atz\u012bts par sp\u0113k\u0101 neeso\u0161u, ta\u010du tas tiesved\u012bbas laik\u0101 jau ir izpild\u012bts, aizskartaj\u0101m person\u0101m vairs nav pieejami efekt\u012bvi l\u012bdzek\u013ci, k\u0101 pan\u0101kt galveno m\u0113r\u0137i, kura d\u0113\u013c t\u0101s v\u0113r\u0161as ties\u0101, t.i., piedal\u012bties tiesisk\u0101 iepirkum\u0101. T\u0101d\u0113\u013c \u0161ajos gad\u012bjumos \u012bpa\u0161i b\u016btisks ir atl\u012bdzin\u0101juma instit\u016bts. Ja vien persona visp\u0101r\u012bgi ir atz\u012bstama par ieinteres\u0113tu attiec\u012bg\u0101 l\u012bguma nosl\u0113g\u0161an\u0101, nav pamata ap\u0161aub\u012bt t\u0101s ties\u012bbas pras\u012bt zaud\u0113jumu atl\u012bdzin\u0101\u0161anu. Savuk\u0101rt iesp\u0113jam\u0101s gr\u016bt\u012bbas pier\u0101d\u012bt zaud\u0113jumu es\u012bbu vai apm\u0113ru attiecin\u0101mas uz tiesved\u012bbu, kur\u0101 tiek (iesp\u0113jams, tiks) pras\u012bta zaud\u0113jumu atl\u012bdzin\u0101\u0161ana, un nevar b\u016bt pamats tiesved\u012bbas izbeig\u0161anai liet\u0101, kur\u0101 p\u0101rbaud\u0101ms pas\u016bt\u012bt\u0101jas r\u012bc\u012bbas tiesiskums. (29.03.2018. <b>SKA-426\/2018<\/b>)<\/p>\n<p><b>L\u012bguma par automobi\u013cu nomu (operat\u012bvo l\u012bzingu) izpild\u012bt\u0101js<\/b> iesniedza ties\u0101 pras\u012bbu pret pas\u016bt\u012bt\u0101ju par zaud\u0113jumu atl\u012bdz\u012bbu, jo uzskat\u012bja, ka atdotie transportl\u012bdzek\u013ci ir boj\u0101ti un konstat\u0113tie defekti neatbilst norm\u0101lam nolietojumam. AT ieskat\u0101 uz operat\u012bv\u0101 l\u012bzinga l\u012bgumu attiecin\u0101mi Civillikuma (CL) noteikumi par nomas tiesiskaj\u0101m attiec\u012bb\u0101m, t\u0101d\u0113\u013c pareizi piem\u0113rots CL 2150. pants, kas noteic, ka nomas un \u012bres priek\u0161mets nomniekam un \u012brniekam j\u0101lieto k\u0101rt\u012bgi un saimnieciski; ja vi\u0146i to ir iev\u0113roju\u0161i, tad vi\u0146iem nav j\u0101atbild par parasto lietas nolieto\u0161anos. Noz\u012bm\u012bgi str\u012bda pareizai iz\u0161\u0137ir\u0161anai ir noteikt, k\u0101di iznom\u0101to automa\u0161\u012bnu defekti un boj\u0101jumi saist\u012bti ar parasto (norm\u0101lo) ekspluat\u0101ciju un k\u0101di boj\u0101jumi radu\u0161ies citu apst\u0101k\u013cu rezult\u0101t\u0101, par kuru nov\u0113r\u0161anu iest\u0101jas atbild\u012bba nomniecei, t\u0101d\u0113\u013c lieta nodota jaunai izskat\u012b\u0161anai. SKC-110\/2018)<\/p>\n<p><b>Finans\u0113juma sa\u0146\u0113m\u0113ji<\/b> (FS): K\u0101d\u0101 liet\u0101 persona, kura izpild\u012bja iepirkuma l\u012bgumu, vienlaikus bija nosl\u0113gusi sadarb\u012bbas l\u012bgumu ar FS, kas paredz\u0113ja ar\u012b ie\u0146\u0113mumu sadal\u012b\u0161anu starp dal\u012bbniekiem. Lauku atbalsta dienests (LAD) konstat\u0113ja, ka personas ir saist\u012btas likuma \u201cPar nodok\u013ciem un nodev\u0101m\u201d izpratn\u0113, t\u0101d\u0113\u013c neapmaks\u0101ja maks\u0101jumu piepras\u012bjum\u0101 iek\u013caut\u0101s izmaksas. T\u0101 k\u0101 pras\u012bjuma priek\u0161mets bija labv\u0113l\u012bga administrat\u012bv\u0101 akta izdo\u0161ana (finans\u0113juma sa\u0146em\u0161ana) un AT saskat\u012bja pe\u013c\u0146as nodo\u0161anas l\u012bguma paz\u012bmes sadarb\u012bbas l\u012bgum\u0101, AT FS s\u016bdz\u012bbu noraid\u012bja. (28.03.2018. <b>SKA-181\/2018<\/b>) Cit\u0101 liet\u0101 LAD bija konstat\u0113jis intere\u0161u konflikta st\u0101vokli, kad iepirkuma par projekta vad\u012bbu uzvar\u0113t\u0101ja atz\u012bta par uzvar\u0113t\u0101ju ar\u012b abos p\u0101r\u0113jos iepirkumos (tehnisk\u0101 projekta izstr\u0101de, melior\u0101cijas sist\u0113mas rekonstrukcija un jaunb\u016bves darbi). Tom\u0113r AT ieskat\u0101 no 04.06.2013. MK noteikumu Nr. 299 (aizst\u0101ti ar 28.02.2017. noteikumiem Nr. 104 \u201cNoteikumi par iepirkuma proced\u016bru un t\u0101s piem\u0113ro\u0161anas k\u0101rt\u012bbu pas\u016bt\u012bt\u0101ja finans\u0113tiem projektiem\u201d) anot\u0101cijas secin\u0101ms, ka intere\u0161u konflikts ir izsme\u013co\u0161i regul\u0113ts Latvijas tiesiskaj\u0101 regul\u0113jum\u0101 un tas nav p\u0113c b\u016bt\u012bbas papla\u0161in\u0101ms, atsaucoties uz ES bud\u017eeta un PIL regul\u0113jumu, bet uz konkr\u0113to situ\u0101ciju neattiecas neviena no MK noteikumos min\u0113taj\u0101m intere\u0161u konflikta situ\u0101cij\u0101m. Vienlaikus noteikumi paredz l\u012bgumcenu pamatot\u012bbas izv\u0113rt\u0113\u0161anas iesp\u0113ju un, pien\u0101c\u012bgi piem\u0113rojot \u0161o instrumentu, var nov\u0113rst p\u0101rk\u0101pumu ar\u012b tad, ja l\u012bgums nosl\u0113gts intere\u0161u konflikta apst\u0101k\u013cos. (08.05.2018. <b>SKA-240\/2018<\/b>) Tas nor\u0101d\u012bts ar\u012b liet\u0101, kur izskat\u012bts str\u012bds par LAD uzlikto pien\u0101kumu atmaks\u0101t p\u0101rmaks\u0101to avansa summu. Papildus AT nor\u0101d\u012bjusi, ka MK noteikumu Nr. 299 12. punkts paredz, ka FS nesl\u0113dz pieg\u0101des, pakalpojumu un b\u016bvdarbu l\u012bgumu ar t\u0101du pieg\u0101d\u0101t\u0101ju, ar kuru tas atrodas intere\u0161u konflikt\u0101 \u0161o noteikumu 13. punkta izpratn\u0113, iz\u0146emot gad\u012bjumus, kas min\u0113ti \u0161o noteikumu 14. punkt\u0101. Atbilsto\u0161i 13.2. apak\u0161punktam uzskata, ka FS un pieg\u0101d\u0101t\u0101js atrodas intere\u0161u konflikt\u0101, ja citstarp FS valdes loceklis ir pieg\u0101d\u0101t\u0101ja vai t\u0101 apak\u0161uz\u0146\u0113m\u0113ja valdes loceklis.
