Tas skaidrojams ar to, ka \u0161o jomu raksturo paaugstin\u0101ti korupcijas riski. V\u0113sturiski saist\u012bb\u0101 ar publiskajiem iepirkumiem ir s\u0101kti vair\u0101ki krimin\u0101lprocesi, piem\u0113ram, VAS \u201cLatvijas Dzelzce\u013c\u0161\u201d, AS \u201cLatvenergo\u201d, RP SIA \u201cR\u012bgas Satiksme\u201d, Daugavpils pils\u0113tas domes iepirkumi. Birojs neveic statistikas datu apkopojumu pa nozar\u0113m, kur\u0101s veic p\u0101rbaudes un s\u0101k krimin\u0101lprocesus. L\u012bdz ar to nav izveidota statistika par iesp\u0113jamiem korupt\u012bva rakstura noziedz\u012bgiem nodar\u012bjumiem tie\u0161i iepirkumu jom\u0101, kuru izmekl\u0113\u0161ana ietilpst Biroja kompetenc\u0113.<\/p>\n<p><b>&#8211; K\u0101di ir secin\u0101jumi par korupcijas riskiem iepirkumu nozar\u0113? Kuros sektoros (valsts\/pa\u0161vald\u012bbu uz\u0146\u0113mumi, iest\u0101des, pa\u0161vald\u012bbas un citi ties\u012bbu subjekti) ir visliel\u0101kie korupcijas riski un, j\u016bsupr\u0101t, k\u0101p\u0113c? <\/b><\/p>\n<p>&#8211; Starp Biroja darb\u012bbas priorit\u0101raj\u0101m jom\u0101m noteikta ar\u012b publisko iepirkumu joma b\u016bvniec\u012bbas, vesel\u012bbas apr\u016bpes nozar\u0113, iepirkumu procesi liel\u0101kaj\u0101s Latvijas pa\u0161vald\u012bb\u0101s, k\u0101 ar\u012b ES l\u012bdzfinans\u0113tajos projektos, kas noz\u012bm\u0113, ka iepirkumu nozarei Biroja ikdienas darb\u0101 piev\u0113rsta pastiprin\u0101ta uzman\u012bba. Par sektoriem ar visaugst\u0101kajiem korupcijas riskiem uzskat\u0101mi:<\/p>\n<p>1)        b\u016bvniec\u012bba, ener\u0123\u0113tika, infrastrukt\u016bras uzlabo\u0161ana;<br \/>\n2)        transporta un milit\u0101rais sektors;<br \/>\n3)        IT un telekomunik\u0101cijas;<br \/>\n4)        farm\u0101cija, vesel\u012bbas apr\u016bpe (diagnostikas iek\u0101rtu iepirkumi).<\/p>\n<p>Faktori, kas b\u016btiski ietekm\u0113 korupcijas risku pieaugumu:<\/p>\n<p>\u2022 iev\u0113rojams pieejamais finans\u0113jums;<br \/>\n\u2022 augsta amatpersonas r\u012bc\u012bbas br\u012bv\u012bba;<br \/>\n\u2022 pastiprin\u0101ta interese no priv\u0101t\u0101 sektora puses;<br \/>\n\u2022 nepietiekama iek\u0161\u0113j\u0101 kontrole.<\/p>\n<p>Birojs, atbilsto\u0161i normat\u012bvajos aktos noteiktajam, veic akt\u012bvu prevencijas darbu, izgl\u012btojot topo\u0161\u0101s un eso\u0161\u0101s amatpersonas. Izgl\u012bto\u0161anas jom\u0101 Biroja uzdevums ir veicin\u0101t sabiedr\u012bbas inform\u0113t\u012bbu par korupcijas negat\u012bvaj\u0101m sek\u0101m. \u0160aj\u0101 nol\u016bk\u0101 Birojs izv\u0113rt\u0113 sabiedr\u012bbas un amatpersonu zin\u0101\u0161anas un izpratni pretkorupcijas jaut\u0101jumos un, balstoties uz rezult\u0101tiem, veic izgl\u012bto\u0161anas pas\u0101kumus t\u0101d\u0101s jom\u0101s k\u0101 pretkorupcijas ties\u012bbu akti, iest\u0101\u017eu veiktie korupcijas nov\u0113r\u0161anas profilaktiskie pas\u0101kumi un \u0113tika, inform\u0113 sabiedr\u012bbu par korupcijas att\u012bst\u012bbas tendenc\u0113m un atkl\u0101taj\u0101m korupcijas liet\u0101m, k\u0101 ar\u012b par veiktajiem pas\u0101kumiem korupcijas nov\u0113r\u0161an\u0101 un apkaro\u0161an\u0101.<\/p>\n<p>Liela noz\u012bme korupcijas risku nov\u0113r\u0161an\u0101 ir ar\u012b starptautiskajai sadarb\u012bbai gan amatpersonu izgl\u012bto\u0161anas, gan iepirkumu uzraudz\u012bbas jom\u0101. B\u016btiski, ka tiek veidota vienota ties\u012bbsarg\u0101jo\u0161o iest\u0101\u017eu (t.sk., starptautisko sadarb\u012bbas partneru \u2013 partnerdienestu) izpratne par iepirkumu procesu uzraudz\u012bbu un taj\u0101 konstat\u0113to noziedz\u012bgo nodar\u012bjumu apkaro\u0161anas jaut\u0101jumiem.<\/p>\n<p>Papildus Birojs analiz\u0113 riskus normat\u012bvaj\u0101 regul\u0113jum\u0101 attiec\u012bb\u0101 uz publiskajiem l\u012bgumiem (pieg\u0101des, pakalpojumi, b\u016bvdarbi), kuru sl\u0113g\u0161an\u0101 nav j\u0101piem\u0113ro \u0101r\u0113jo normat\u012bvo aktu regul\u0113jums, iz\u0146emot Publiskas personas finan\u0161u l\u012bdzek\u013cu un mantas iz\u0161\u0137\u0113rd\u0113\u0161anas nov\u0113r\u0161anas likuma pras\u012bbas (\u201czemsliek\u0161\u0146a\u201d iepirkums). Birojs ir konstat\u0113jis, ka \u201czemsliek\u0161\u0146a\u201d iepirkumu organiz\u0113\u0161ana nav pietiekami caurskat\u0101ma un past\u0101v augsts pas\u016bt\u012bt\u0101ja negodpr\u0101t\u012bgas r\u012bc\u012bbas risks, jo \u201czemsliek\u0161\u0146a\u201d iepirkumu organiz\u0113\u0161anu (r\u012bc\u012bbu ar publiskas personas mantu) regul\u0113 vien\u012bgi Publiskas personas finan\u0161u l\u012bdzek\u013cu un mantas iz\u0161\u0137\u0113rd\u0113\u0161anas nov\u0113r\u0161anas likums, k\u0101 ar\u012b normat\u012bvie akti publiskas personas instit\u016bcij\u0101m neuzliek par pien\u0101kumu public\u0113t inform\u0101ciju par publiskajiem l\u012bgumiem, kas nosl\u0113gti nepiem\u0113rojot Publisko iepirkumu likuma pras\u012bbas.<\/p>\n<p><b>&#8211; Ko KNAB dara korupcijas risku mazin\u0101\u0161an\u0101 iepirkumu nozar\u0113? Kas b\u016btu j\u0101dara \u0161aj\u0101 nozar\u0113 str\u0101d\u0101jo\u0161ajiem darbiniekiem, lai \u0161os riskus vismaz mazin\u0101tu? <\/b><\/p>\n<p>&#8211; Korupcijas risku mazin\u0101\u0161anai publiskajos iepirkumos Birojs regul\u0101ri veic risku anal\u012bzi, identific\u0113jot korupcijas riskiem vair\u0101k pak\u013caut\u0101s jomas. Biroja noz\u012bm\u012bg\u0101kie resursi tiek koncentr\u0113ti uz korupcijas riskiem vair\u0101k pak\u013cautaj\u0101m jom\u0101m, kur\u0101s tiek veikti publiskie iepirkumi. Biroja ieskat\u0101 inform\u0101cijai par publiskajiem l\u012bgumiem, kas nosl\u0113gti, nepiem\u0113rojot Publisko iepirkumu likuma pras\u012bbas, j\u0101b\u016bt publiski pieejamai. Tas nodro\u0161in\u0101tu liel\u0101ku publisko iepirkumu caursp\u012bd\u012bgumu, kas palielina iesp\u0113ju iesaist\u012bties sabiedr\u012bbai, t\u0101d\u0113j\u0101di veicinot savlaic\u012bg\u0101ku korupcijas, negodpr\u0101t\u012bgas konkurences un publiskas personas finan\u0161u l\u012bdzek\u013cu un mantas iz\u0161\u0137\u0113rd\u0113\u0161anas risku identific\u0113\u0161anu.<\/p>\n<p>Birojs past\u0101v\u012bgi un regul\u0101ri r\u012bko semin\u0101rus par korupcijas un intere\u0161u konflikta nov\u0113r\u0161anu, publisk\u0101s p\u0101rvaldes \u0113tiku, iek\u0161\u0113j\u0101s kontroles pas\u0101kumiem korupcijas risku nov\u0113r\u0161anai.<\/p>\n<p>Sadarb\u012bb\u0101 ar Konkurences padomi un Iepirkumu uzraudz\u012bbas biroju da\u017e\u0101dos Latvijas re\u0123ionos 2017. un 2018. gad\u0101 tika organiz\u0113ts semin\u0101ru cikls \u201cPar god\u012bgu uz\u0146\u0113m\u0113jdarb\u012bbu\u201d. Semin\u0101ru m\u0113r\u0137is bija izgl\u012btot divas m\u0113r\u0137a grupas \u2013 valsts un pa\u0161vald\u012bbu p\u0101rst\u0101vjus, kuru ikdienas darb\u012bba ir saist\u012bta ar iepirkumu jomu, un uz\u0146\u0113m\u0113jus. Semin\u0101ros Valsts un pa\u0161vald\u012bbu iepirkumu r\u012bkot\u0101jiem bija iesp\u0113ja paaugstin\u0101t savas zin\u0101\u0161anas par iepirkumu jomu, t\u0101d\u0113j\u0101di veicinot darb\u012bbas efektivit\u0101ti. Tikm\u0113r uz\u0146\u0113m\u0113jiem \u2013 papla\u0161in\u0101t zin\u0101\u0161anas par sav\u0101m ties\u012bb\u0101m un pien\u0101kumiem, lai var\u0113tu veiksm\u012bgi izmantot likum\u0101 at\u013caut\u0101s sadarb\u012bbas iesp\u0113jas, aizst\u0101v\u0113t savas intereses, ja normat\u012bvos aktus p\u0101rk\u0101pj cits uz\u0146\u0113m\u0113js, k\u0101 ar\u012b nep\u0101rk\u0101pt tos nepietiekamu zin\u0101\u0161anu d\u0113\u013c. Biroja ieskat\u0101 noz\u012bm\u012bgi un \u012bpa\u0161i svar\u012bgi ikvien\u0101 valsts un pa\u0161vald\u012bbas iest\u0101d\u0113 ir sagatavot un ieviest kvalitat\u012bvu iek\u0161\u0113j\u0101s kontroles sist\u0113mu, k\u0101 to paredz 2017. gada 17. oktobra Ministru kabineta noteikumi Nr. 630 \u201cNoteikumi par iek\u0161\u0113j\u0101s kontroles sist\u0113mas pamatpras\u012bb\u0101m korupcijas un intere\u0161u konflikta riska nov\u0113r\u0161anai publiskas personas instit\u016bcij\u0101\u201d.<\/p>\n<p><b>&#8211; K\u0101 v\u0113rt\u0113jamas p\u0113d\u0113jo m\u0113ne\u0161u aiztur\u0113\u0161anas saist\u012bb\u0101 ar PSIA \u201cR\u012bgas satiksme\u201d veiktajiem iepirkumiem &#8211; k\u0101 regul\u0101ras, sistem\u0101tiskas KNAB darb\u012bbas rezult\u0101ts vai t\u0101m bija citi iemesli? <\/b><\/p>\n<p>&#8211; Biroja uzs\u0101ktie krimin\u0101lprocesi ir ilgsto\u0161a un anal\u012btiska komandas darba rezult\u0101ts.<\/p>\n<p><b>&#8211;  Vai saredzat e &#8211; konkursu sist\u0113mu k\u0101 l\u012bdzekli korupcijas risku mazin\u0101\u0161an\u0101 publiskajos iepirkumos? K\u0101 v\u0113rt\u0113jat \u0161\u0101s sist\u0113mas darb\u012bbu \u0161\u0101 br\u012b\u017ea veidol\u0101? <\/b><\/p>\n<p>&#8211; Jebkuri jaunievedumi, kas veicina iepirkuma procesu caurskat\u0101m\u012bbu, k\u0101 ar\u012b konsekventu pras\u012bbu izpildi, noteikti ir noz\u012bm\u012bgs solis, lai mazin\u0101tu korupcijas riskus iepirkumu vid\u0113. Piebild\u012bsm, ka ne tikai iepirkumu nozar\u0113, bet ar\u012b kop\u0101 \u0146emot, kuku\u013co\u0161ana aizvien maz\u0101k ir nov\u0113rojama t\u0101s klasiskaj\u0101 form\u0101. Praks\u0113 aizvien bie\u017e\u0101k konstat\u0113jams, ka kukuli \u201csl\u0113pj\u201d aiz da\u017e\u0101da veida dar\u012bjumiem. Nozieguma veic\u0113ji aizvien bie\u017e\u0101k piesaista augstas klases speci\u0101listus, kas veic korupt\u012bva rakstura nozieguma pl\u0101no\u0161anu un noziegumu sh\u0113mu izveidi. L\u012bdz ar to var secin\u0101t, ka korupt\u012bva nozieguma paveik\u0161anas formas k\u013c\u016bst komplic\u0113t\u0101kas,  rafin\u0113t\u0101kas, kas pastiprina \u0161\u012b nozieguma veida latento dabu. V\u0113rojama tendence, ka korupt\u012bvos dar\u012bjumos akt\u012bvi iesaist\u0101s priv\u0101tpersonas, kuras veic organizatoru, starpnieku un atbalst\u012bt\u0101ju funkcijas.
