Lab\u0101kai izpratnei aicinu iepaz\u012bties ar\u012b ar pilnu nol\u0113mumu tekstu<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup>.<\/p>\n<p>SIA \u201cFirma L4\u201d ir viens no vado\u0161ajiem in\u017eenieru un konsultantu birojiem Latvij\u0101, kas l\u012bdztekus projekt\u0113\u0161anas un b\u016bvuzraudz\u012bbas pakalpojumiem sniedz ar\u012b konsult\u0101cijas publisko iepirkumu jom\u0101. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Sarunu proced\u016bras piem\u0113ro\u0161ana<\/span><\/strong><\/p>\n<p>Par J\u016brmalas pils\u0113tas pa\u0161vald\u012bbas autoce\u013cu ikdienas uztur\u0113\u0161anas iepirkumiem jau agr\u0101k biju\u0161i vair\u0101ki spriedumi. \u0160ogad AT izv\u0113rt\u0113jusi pamatojumu sarunu proced\u016bras bez iepriek\u0161\u0113j\u0101 pazi\u0146ojuma piem\u0113ro\u0161anai, nor\u0101dot, ka ar nepiecie\u0161am\u012bbu p\u0113c pakalpojuma nepietiek, lai pieg\u0101d\u0101t\u0101ju var\u0113tu izv\u0113l\u0113ties proced\u016br\u0101, kas b\u016btiski ierobe\u017eo konkurenci. Par neparedzamiem apst\u0101k\u013ciem var tikt uzskat\u012bti t\u0101di apst\u0101k\u013ci, kurus objekt\u012bvi, piev\u0113r\u0161oties attiec\u012bgajam jaut\u0101jumam ar pien\u0101c\u012bgu r\u016bp\u012bbu, nav iesp\u0113jams paredz\u0113t. Savuk\u0101rt par \u0101rk\u0101rtas apst\u0101k\u013ciem uzskat\u0101mi t\u0101di apst\u0101k\u013ci, kas neatbilst parastajai k\u0101rt\u012bbai. Tas, ka iepirkuma rezult\u0101ti ir p\u0101rs\u016bdz\u0113ti un Iepirkumu uzraudz\u012bbas birojs (IUB) aizliedzis sl\u0113gt l\u012bgumu, nav uzskat\u0101ms ne par neparedzamu, ne ar\u012b par \u0101rk\u0101rtas apst\u0101kli. <b>AT ar\u012b nor\u0101da, ka ar favor\u012btismu publiskajos iepirkumos tiek apz\u012bm\u0113ta nepamatotu priek\u0161roc\u012bbu vai labv\u0113l\u012bgu apst\u0101k\u013cu rad\u012b\u0161ana konkr\u0113tam pas\u016bt\u012bt\u0101ja subjekt\u012bvi izraudz\u012btam pretendentam, pasarg\u0101jot to no re\u0101las konkurences. \u0160\u0101da r\u012bc\u012bba publiskajos iepirkumos ir absol\u016bti izskau\u017eama par\u0101d\u012bba <\/b>(29.03.2018. SKA-426\/2018).<br \/>\n<!--more--><br \/>\nPubliskaj\u0101 telp\u0101 rezonansi ieguvusi ar\u012b lieta par SIA \u201cR\u012bgas satiksme\u201d paaugstin\u0101ta servisa sabiedrisk\u0101 transporta pakalpojumu snieg\u0161anas iepirkumu, kur cita starp\u0101 AT interpret\u0113 Regulas Nr.1370\/2007 5. panta 5. punktu. Taj\u0101 paredz\u0113ts iz\u0146\u0113mums no atkl\u0101tas konkursa proced\u016bras, ja sabiedrisk\u0101 transporta pakalpojumu snieg\u0161an\u0101 iest\u0101jies p\u0101rtraukums, pirm\u0161\u0137ietami to tulkojot k\u0101 piem\u0113rojamu, ja tiks p\u0101rtraukti sabiedrisk\u0101 transporta pakalpojumi visp\u0101r (t.i., attiec\u012bgaj\u0101 administrat\u012bvaj\u0101 teritorij\u0101 tiek p\u0101rtraukti piln\u012bb\u0101 vai netiek nodro\u0161in\u0101ti k\u0101dai iedz\u012bvot\u0101ju grupai), nevis p\u0101rtraukts tikai konkr\u0113tais sabiedrisk\u0101 transporta pakalpojums, par kura l\u012bguma nosl\u0113g\u0161anu ir str\u012bds, jo iz\u0146\u0113mumi ir tulkojami \u0161auri (12.02.2018. SKA-903\/2018).<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Pras\u012bbas un atbilst\u012bba<\/span><\/strong><\/p>\n<p> AT k\u0101rt\u0113jo reizi atg\u0101dina, ka jebkuras pras\u012bbas kaut k\u0101d\u0101 m\u0113r\u0101 sa\u0161aurina personu loku, kuras var\u0113tu piedal\u012bties iepirkum\u0101, ta\u010du <b>nepie\u013caujami ir nevis jebkuri, bet vien\u012bgi nepamatoti konkurences ierobe\u017eojumi<\/b>. Pat ja pras\u012bb\u0101m atbilst mazs uz\u0146\u0113mumu loks, tas nenoz\u012bm\u0113, ka pras\u012bbas nepamatoti ierobe\u017eo konkurenci un ir prettiesiskas. B\u016btiski, vai pras\u012bbas ir objekt\u012bvi pamatotas un nav diskrimin\u0113jo\u0161as. Pas\u016bt\u012bt\u0101jam, nosakot kvalifik\u0101cijas pras\u012bbas, ir r\u012bc\u012bbas br\u012bv\u012bba, kas v\u0113rsta uz to, lai pied\u0101v\u0101jums atbilstu pas\u016bt\u012bt\u0101ja iecer\u0113m, un tas sa\u0146emtu iepirkuma priek\u0161metam atbilsto\u0161u un p\u0113c iesp\u0113jas kvalitat\u012bvu izpild\u012bjumu. T\u0101d\u0113\u013c pretendentu un ar\u012b tiesas v\u0113rt\u0113jums par to, ka pakalpojumu, iesp\u0113jams, var izpild\u012bt ar\u012b ar zem\u0101ku vai ar citu kvalifik\u0101ciju, liel\u0101 m\u0113r\u0101 b\u016btu spekulat\u012bvs un \u0101rpus to kompetences. Tom\u0113r<b> izvirz\u012btaj\u0101m pras\u012bb\u0101m j\u0101b\u016bt v\u0113rst\u0101m tikai un vien\u012bgi uz iepirkuma priek\u0161metam atbilsto\u0161a un p\u0113c iesp\u0113jas kvalitat\u012bv\u0101ka izpild\u012bjuma sa\u0146em\u0161anu, nevis uz k\u0101du citu intere\u0161u nodro\u0161in\u0101\u0161anu<\/b>. \u0145emot v\u0113r\u0101 no Publisko iepirkumu likuma (PIL) izrieto\u0161o pien\u0101kumu noteikt kvalifik\u0101cijas pras\u012bbas sam\u0113r\u012bgi ar l\u012bguma priek\u0161metu, <b>pas\u016bt\u012bt\u0101jam kvalifik\u0101cijas pras\u012bbu noteik\u0161an\u0101 nav tik liela r\u012bc\u012bbas br\u012bv\u012bba, k\u0101 nosakot iepirkuma priek\u0161metam izvirz\u0101m\u0101s pras\u012bbas vai v\u0113rt\u0113\u0161anas krit\u0113rijus<\/b>. B\u016btiski ir tas, vai pras\u012bbas ir objekt\u012bvi pamatotas (ir v\u0113rstas uz kvalitat\u012bva pakalpojuma ieg\u0101di, nevis uz citu intere\u0161u nodro\u0161in\u0101\u0161anu) un sam\u0113r\u012bgas ar l\u012bguma priek\u0161metu. Ar\u012b tas, k\u0101das tehnolo\u0123ijas izmantot, ir pas\u016bt\u012bt\u0101ja iz\u0161\u0137ir\u0161an\u0101s, un ir tie\u0161i saist\u012bts ar saimnieciska rakstura (lietder\u012bbas) apsv\u0113rumiem, ko tiesa administrat\u012bvaj\u0101 proces\u0101 nevar p\u0101rbaud\u012bt. <b>Ne tiesa, ne pretendenti nevar pas\u016bt\u012bt\u0101jam dikt\u0113t, k\u0101das ier\u012bces, tehnolo\u0123ijas vai programmas b\u016btu j\u0101izmanto savas darb\u012bbas nodro\u0161in\u0101\u0161anai (b\u016btu izdev\u012bg\u0101kas, \u0113rt\u0101kas, lab\u0101kas utt.). Savuk\u0101rt nov\u0113rt\u0113t var to, vai pas\u016bt\u012bt\u0101js sp\u0113j objekt\u012bvi pamatot pras\u012bbu p\u0113c pieredzes ar konkr\u0113to tehnolo\u0123iju vai k\u0101du t\u0101s versiju<\/b>. T\u0101pat pas\u016bt\u012bt\u0101jam ir j\u0101dom\u0101 par to, vai veids, k\u0101d\u0101 par pras\u012bb\u0101m p\u0101rliecin\u0101ties, nerada p\u0101rm\u0113r\u012bgu slogu ab\u0101m pus\u0113m. Pieredze noteikta finansi\u0101la apjoma projektu izpild\u0113 ir viens no vienk\u0101r\u0161\u0101kajiem veidiem, k\u0101 var p\u0101rliecin\u0101ties par pretendenta pieredzi (21.05.2018. SKA-1222\/2018). <\/p>\n<p>AT ar\u012b atg\u0101din\u0101jusi, ka formul\u0113jum\u0101 ir iet\u0113rpta pas\u016bt\u012bt\u0101ja griba konkr\u0113t\u0101 iepirkuma kontekst\u0101, un nolikuma interpret\u0101cijas m\u0113r\u0137is ir noskaidrot, k\u0101da bijusi \u0161\u012b griba. Str\u012bd\u0101 par darba izpildes organizatorisk\u0101s strukt\u016bras aprakstu AT secina, ka no nolikuma skaidri un nep\u0101rprotami izriet, ka ir j\u0101iesniedz apraksts par pied\u0101v\u0101to darbu izpildes organizatorisko strukt\u016bru. \u0160\u0101das pras\u012bbas j\u0113ga var\u0113tu b\u016bt rad\u012bt p\u0101rliec\u012bbu, ka pretendents izprot veicamos darbus, un ir iecer\u0113jis tos \u012bstenot atbilsto\u0161i tehnisk\u0101s specifik\u0101cijas un normat\u012bvo aktu pras\u012bb\u0101m. Var uzskat\u012bt, ka iesaist\u012bt\u0101s personas, to pien\u0101kumi un atbild\u012bba ir galvenie \u0161\u0101du strukt\u016bru raksturojo\u0161ie elementi. Ar\u012b nodarbin\u0101mo skaits var liecin\u0101t par to, vai pretendents izprot darbu apjomu un specifiku, un sp\u0113s izpild\u012bt visas tehnisk\u0101s specifik\u0101cijas pras\u012bbas, tom\u0113r iz\u0161\u0137iro\u0161i ir, vai \u0161\u0101da pras\u012bba ir tie\u0161i nor\u0101d\u012bta nolikum\u0101, kas konkr\u0113taj\u0101 gad\u012bjum\u0101 netiek secin\u0101ts. <b>Nolikum\u0101 nav preciz\u0113ta iesniedzam\u0101 apraksta detaliz\u0101cijas pak\u0101pe, t\u0101tad par to, vai iesniegtais apraksts ir (pietiekami) detaliz\u0113ts min\u0113t\u0101s pras\u012bbas izpratn\u0113, pas\u016bt\u012bt\u0101jam ir nov\u0113rt\u0113juma br\u012bv\u012bba (paturot pr\u0101t\u0101 m\u0113r\u0137i, ar k\u0101du attiec\u012bgais apraksts visp\u0101r tika pras\u012bts). Tiesa savuk\u0101rt var p\u0101rbaud\u012bt, vai pas\u016bt\u012bt\u0101js nav pie\u013c\u0101vis ac\u012bmredzamas k\u013c\u016bdas nov\u0113rt\u0113juma br\u012bv\u012bbas izmanto\u0161an\u0101<\/b>. SKA-537\/2018)  <\/p>\n<p>AT ar\u012b v\u0113rt\u0113jusi pras\u012bbas materi\u0101lam autoce\u013cu remontdarbiem, secinot, ka, pret\u0113ji pieg\u0101d\u0101t\u0101ja apgalvojumiem, no iepirkuma dokumentiem objekt\u012bvi bija saprotams, ko pas\u016bt\u012bt\u0101js ir paredz\u0113jis izmantot un, ja tom\u0113r par to rad\u0101s \u0161aubas, bija iesp\u0113jams uzdot jaut\u0101jumu. K\u0101 atbilst\u012bbas apliecin\u0101jums nav izmantojami dokumenti, kurus sagatavojusi pati pas\u016bt\u012bt\u0101ja, un pieteic\u0113jai tajos vien\u012bgi j\u0101nor\u0101da cena un j\u0101parakst\u0101s, jo tas nav pietiekams pamats, lai secin\u0101tu, ka pieteic\u0113jai pieejami tie resursi, uz kuriem \u0161ajos dokumentos nor\u0101d\u012bjusi pas\u016bt\u012bt\u0101ja, t\u0101 k\u0101 tehniskaj\u0101 pied\u0101v\u0101jum\u0101 pa\u0161am pretendentam ar\u012b j\u0101nor\u0101da materi\u0101ls, k\u0101du tas paredz\u0113jis izmantot, un \u0161\u0101 materi\u0101la ieguves vieta. SKA-76\/2018). <\/p>\n<p>K\u0101 redzams, tiesa pras\u012bbas \u201cskaidr\u012bbu\u201d analiz\u0113s atkar\u012bb\u0101 no konkr\u0113t\u0101s situ\u0101cijas, pras\u012bbas formul\u0113juma u.c. un pieg\u0101d\u0101t\u0101jiem vienm\u0113r ieteicams laic\u012bgi uzdot jaut\u0101jumus neskaidr\u012bbu gad\u012bjum\u0101. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Finan\u0161u pied\u0101v\u0101jums<\/span><\/strong><\/p>\n<p> Vair\u0101kk\u0101rt skat\u012bta ar\u012b lieta, kur\u0101, v\u0113rt\u0113jot finan\u0161u pied\u0101v\u0101jumu, secin\u0101ts, ka da\u013ca apkopes izmaksu ir ietvertas b\u016bvniec\u012bbas izmaks\u0101s. AT iepriek\u0161 nor\u0101d\u012bja, ka tas, ka pretendents nepiecie\u0161am\u0101s deta\u013cas vai materi\u0101lus ieg\u0101d\u0101jies kop\u0101 ar iek\u0101rtu, nenoz\u012bm\u0113, ka to cena komplekta ietvaros nav j\u0101uzr\u0101da pie apkalpo\u0161anas izmaks\u0101m. Min\u0113tie apsv\u0113rumi atspogu\u013co lo\u0123ik\u0101 un saimnieciskaj\u0101 realit\u0101t\u0113 balst\u012btu uzskatu, ka tad, <b>ja visp\u0101r k\u0101dai lietai ir v\u0113rt\u012bba, nevar prezum\u0113t, ka t\u0101 pretendentam vai pas\u016bt\u012bt\u0101jam ir bez maksas. T\u0101tad, ja visp\u0101r attiec\u012bg\u0101 veida izmaksas var rasties, pas\u016bt\u012bt\u0101jam nav pamata uzskat\u012bt, ka konkr\u0113taj\u0101 gad\u012bjum\u0101 t\u0101s nerad\u012bsies, ja vien tas skaidri un objekt\u012bvi nav secin\u0101ms no pied\u0101v\u0101juma<\/b>, t\u0101 skaidrojuma un citiem pier\u0101d\u012bjumiem. To, ka attiec\u012bg\u0101s rezerves da\u013cas tiktu sa\u0146emtas visp\u0101r par velti, pieteic\u0113ja s\u0101ka nor\u0101d\u012bt tikai tiesas procesa laik\u0101. Attiec\u012bgi pas\u016bt\u012bt\u0101ja var\u0113ja uzskat\u012bt, ka pieteic\u0113ja apkopes izmaks\u0101s nav iek\u013c\u0101vusi visas izmaksas. (19.03.2018. SKA-935\/2018) T\u0101tad, ja finan\u0161u pied\u0101v\u0101juma poz\u012bcij\u0101 ir pras\u012bts atsevi\u0161\u0137i izdal\u012bt izmaksas un t\u0101s visp\u0101r past\u0101v, pieg\u0101d\u0101t\u0101jam t\u0101s ir j\u0101nor\u0101da, ja tas nav iesp\u0113jams \u2013 j\u0101uzdod jaut\u0101jums pas\u016bt\u012bt\u0101jam. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Nodok\u013cu par\u0101di<\/span><\/strong><\/p>\n<p> AT noraid\u012bjusi IUB kas\u0101cijas s\u016bdz\u012bbu liet\u0101, kas saist\u012bta ar Valsts ie\u0146\u0113mumu dienesta (VID) l\u0113mumu par nodok\u013cu par\u0101da samaksas sadal\u012b\u0161anu termi\u0146os. AT jau iepriek\u0161 nor\u0101d\u012bjusi, ka likumdev\u0113js PIL 39.1(6)2 skaidri noteicis formu, k\u0101dai j\u0101atbilst l\u0113mumam par nodok\u013cu samaksas termi\u0146a pagarin\u0101\u0161anu vai atlik\u0161anu, vai vieno\u0161an\u0101s ar dienestu par nodok\u013cu par\u0101da nomaksu, lai t\u0101 var\u0113tu tikt atz\u012bta par nodok\u013cu par\u0101da nees\u012bbas pier\u0101d\u012bjumu iepirkuma proced\u016br\u0101. Tostarp likumdev\u0113js tie\u0161i paredz\u0113jis (iepriek\u0161\u0113j\u0101 normas redakcij\u0101 \u2013 aut.), ka l\u0113mumam par nodok\u013cu samaksas termi\u0146a pagarin\u0101jumu j\u0101b\u016bt pie\u0146emtam pirms pied\u0101v\u0101jumu iesnieg\u0161anas termi\u0146a p\u0113d\u0113j\u0101s dienas. Iev\u0113rojot min\u0113to, nav akcept\u0113jama t\u0101da normas interpret\u0101cija, ka t\u0101ds pats pier\u0101d\u012bjums ar formas defektiem var\u0113tu ietilpt to pier\u0101d\u012bjumu lok\u0101, kuru uzskait\u012bjumu likumdev\u0113js atst\u0101jis atkl\u0101tu. PIL normas paredz pretendenta pien\u0101kumu nok\u0101rtot nodok\u013cu saist\u012bbas l\u012bdz pied\u0101v\u0101jumu iesnieg\u0161anai, savuk\u0101rt p\u0113c tam iesniegt vien\u012bgi apliecin\u0101jumu par \u0161\u0101 pien\u0101kuma izpildi. AT neuzskata, ka \u0161is ierobe\u017eojums ir pa\u0161m\u0113r\u0137\u012bgs un t\u0101d\u0113\u013c v\u0113rt\u0113jams k\u0101 likumdev\u0113ja gribas defekts, k\u0101 kas\u0101cijas s\u016bdz\u012bb\u0101 nor\u0101da IUB. Ja pretendents pied\u0101v\u0101jumu iesnieg\u0161anas termi\u0146a p\u0113d\u0113j\u0101 dien\u0101 v\u0113r\u0161as VID, tas noz\u012bm\u0113 to, ka nodok\u013cu saist\u012bbas tikai tad s\u0101ktas k\u0101rtot, nevis termi\u0146a p\u0113d\u0113j\u0101 dien\u0101 jau bija nok\u0101rtotas, bet, to akcept\u0113jot, netiktu iev\u0113rots PIL 39.1(5) m\u0113r\u0137is. AT nor\u0101da, ka ar\u012b tas, ka v\u0113l\u0101k pie\u0146emtos publisko iepirkumu jomu regul\u0113jo\u0161os likumos l\u012bdz\u012bgas normas vairs nenoteic konkr\u0113tu laiku, l\u012bdz kuram j\u0101b\u016bt pie\u0146emtam VID l\u0113mumam, ne\u013cauj prezum\u0113t, ka t\u0101ds bijis ar\u012b iepriek\u0161 sp\u0113k\u0101 biju\u0161o normu saturs vai ka l\u0113muma pie\u0146em\u0161anas laika ierobe\u017eojums b\u016btu tobr\u012bd sp\u0113k\u0101 biju\u0161\u0101 likuma pl\u0101nam pret\u0113ja nepiln\u012bba. <b>AT ieskat\u0101 ar\u012b \u0161obr\u012bd sp\u0113k\u0101 eso\u0161\u0101 PIL norma, uz kuru IUB atsaucas kas\u0101cijas s\u016bdz\u012bb\u0101 (42(6)3), nav pietiekami skaidri formul\u0113ta, lai no t\u0101s teksta nep\u0101rprotami var\u0113tu secin\u0101t likumdev\u0113ja gribu attiec\u012bb\u0101 uz VID l\u0113muma pie\u0146em\u0161anas laiku<\/b>. (01.06.2018. SKA-490\/2018). K\u0101 redzams, IUB un AT viedoklis konkr\u0113taj\u0101 jaut\u0101jum\u0101 at\u0161\u0137\u012br\u0101s, t\u0101d\u0113\u013c b\u016btu noder\u012bgs skaidrojums par normas piem\u0113ro\u0161anu. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">L\u012bguma izpilde<\/span><\/strong><\/p>\n<p> AT Civillietu departaments liet\u0101 par 2010. gada l\u012bguma ar l\u012bgumcenu l\u012bdz 10 000 Ls izpildi, kura faktiski tika p\u0101rsniegta, nor\u0101da, ka, apmierinot pras\u012bbu par visas summas samaksu, iepirkum\u0101 noteiktais limits tiktu p\u0101rsniegts par 24 615,81 euro, ta\u010du \u0161\u0101da pieeja ir netaisn\u012bga, jo rada nevienl\u012bdz\u012bgu attieksmi pret p\u0101r\u0113jiem pretendentiem, kuri piedal\u012bj\u0101s konkurs\u0101.
